New Challenges for Private Employers

The National Labor Relations Board has significant authority over private-sector U.S. workplaces. Known primarily for overseeing disputes between unions and employers, the agency’s enforcement of the National Labor Relations Act affects most non-unionized companies as well.

The membership of the 5-member Board shifts perspectives based on the appointing President. Recently, Biden appointees have taken over the majority position on the Board. As a result, the NLRB is expected to pursue a dramatically more pro-labor/employee and less employer-friendly agenda.
