Preparing Employers for the NY HERO Act:

First Look at Major Workplace Safety Developments

On May 5, 2021, Governor Andrew Cuomo signed the New York “HERO Act.” Billed as legislation to help essential workers, the Act has broad implications for all private-sector employers in the State.

The HERO Act has two distinct components:

  1. Requires airborne infectious disease exposure prevention plans for all New York companies.
  2. Permits employees to voluntarily create workplace safety commissions in businesses with at least 10 employees.

Media reports on the NY HERO Act do not fully explain the significant implications for employers. The workplace safety committee requirements, in particular, could be immense. These new employee protections extend far beyond COVID-19, airborne infectious diseases, and even health and safety.
